Dotychczas terminem umownym, do którego inwestorzy mieli możliwość złożenia deklaracji PIT-38 związanej z podatkiem giełdowym był ostatni dzień kwietnia. W tym roku zaszły jednak spore zmiany wynikające z obecnej trudnej, nie tylko dla inwestorów sytuacji gospodarczej powstałej w wyniku wybuchu epidemii korna wirusa na całym świecie. Jakie są to zmiany i jak wyglądają obecne nieprzekraczalne terminy na złożenie deklaracji PIT?
Składanie deklaracji PIT-38 możliwe do końca maja
Trudna sytuacja gospodarcza, w której znalazło się wielu Polaków wymusiła na polskim rządzie podjęcia kilku zmian mających na celu wsparcie przedsiębiorców i firm. Rozwiązaniem kłopotów zaproponowanym przez władze ma być dokument o nazwie„Tarcza Antykryzysowa”, zawierający szereg nowych przepisów oraz regulacji, mających usprawnić i wesprzeć działanie polskiej gospodarki oraz niedopuszczenie do plajty wielu rodzimych przedsiębiorstw i firm. W „Tarczy Antykryzysowej” znalazły się również wpisy odnoszące się do deklaracji podatkowych, w tym PIT-38 dotyczącej podatku giełdowego. Zwyczajowo przyjętym wcześniej terminem na złożenie deklaracji był zawsze 30 kwietnia.
Podpisanie dokumentu przez rząd wydłużyło ten czas do końca maja. Informację na ten temat zamieszczono na stronie gov.pl. Wynika z niej jasno, że ewentualne opóźnienie w złożeniu deklaracji podatkowej PIT dotyczącej ubiegłego roku nie podlegają odpowiedzialności karnej w przypadku, gdy podatnik nie zdąży dostarczyć jej do właściwego urzędu do dnia 30 kwietnia 2020 roku.
Jednocześnie gov.pl informuje, że w takiej sytuacji podatnik nie musi już składać wyjaśnień, czyli tak zwanego „czynnego żalu”, nie ponosi również z tego tytułu żadnej odpowiedzialności karno-skarbowej na rzecz państwa. Oczywiście sytuacja taka obowiązuje tylko w przypadku, gdy deklaracja zostanie dostarczona do urzędu przed końcem maja bieżącego roku.
Wsparcie dla Organizacji Pożytku Publicznego również wydłużono
Zapisy zawarte w „Tarczy Antykryzysowej” odnoszą się również do zwyczajowego przekazywania 1% podatku na wsparcie wybranej przez siebie Organizacji Pożytku Publicznego. Portal Mony.pl donosi swoim czytelnikom, że wcześniejsze ustalenia w tym temacie są już nieaktualne. Dawniej podatnik, który spóźnił się ze złożeniem deklaracji nie miał możliwości przekazania 1 % swojego podatku żadnej z OPP. Obecnie sytuacja i zapisy w „Tarczy Antykryzysowej” zmieniają ten stan rzeczy i pozwalają podatnikowi naprze kazanie tego rodzaju wsparcia poprzez złożenie odpowiedniego oświadczenia do dnia 1 czerwca bieżącego roku. Jedynym warunkiem, jaki musi spełnić podatnik, aby jego 1% został przekazany do wybranej Organizacji Pożytku Publicznego jest zapłata naliczonego podatku do końca czerwca 2020.
