Okoliczność ta, z pewnością jest warta uwagi, porównując do negatywnej dla podatników nowelizacji ustawy o podatkach dochodowych oraz aktualnego orzecznictwa organów podatkowych, które znacznie ogranicza ilość wydatków, zaliczanych do kosztów uzyskania przychodu. Chodzi tu wydatki związane m.in. z wykopywaniem wirtualnej waluty.
Wątpliwości gnębiące górników kryptowalut
Jedna ze spółek podlegających opodatkowaniu podatkiem dochodowym od osób prawnych wskazała, że zamierza prowadzić platformę internetową, w ramach której zarejestrowani użytkownicy oraz spółka będą mogli pozyskiwać, czyli wykopywać kryptowaluty. Po zdobyciu kryptowalut z wykorzystaniem swojej platformy spółka ta ma zamiar wymieniać je na inne kryptowaluty i sprzedawać, wykorzystując do tego dedykowane wirtualne giełdy.
Według spółki wydobywana waluta np. bitcoin jest wirtualnym znakiem legitymacyjnym podobnym do bezgotówkowego pieniądza. Są one zapisem cyfrowym, przechowywanym w wersji elektronicznej, co odbywa się bez podmiotów trzecich zwykle na dysku twardym komputera w specjalnym portfelu. Prawo własności do kryptowalut może powstać pierwotnie lub wtórnie.
Pierwotne powstanie polega na wydobyciu waluty dzięki wykorzystaniu mocy obliczeniowej posiadanego komputera lub z użyciem kopalni kryptowalut. Skutkuje to powstaniem przychodu w podatku dochodowym od osób prawnych.
Podatnik kryptowalut i jego stanowisko
Spółka twierdzi, że wydobycie kryptowalut nie jest przychodem podatkowym. Tzn., że od wydobycie bitcoina nie trzeba odprowadzać podatku. Podatnik zaznaczył, że przepisy prawa podatkowego nie pozwalają przyjąć, że tego typu zdarzenie może skutkować przychodem wskazanym w ustawie o CIT.
Co więcej, w świetle przepisu z art. 12 ust. 3a ustawy o CIT rzeczą, która decyduje o powstaniu przychodu podatkowego, jest zajście najwcześniejszego momentu wyznaczonego w nim. Jest nim np. dzień wydania przedmiotu, wykonania usługi lub zbycia prawa majątkowego. Wyjątkiem jest wcześniejsze wystawienie faktury, lub przyjęcie zapłaty, wówczas w tym dniu powstaje przychód.
Wśród czynności prawnych ustalających moment powstania przychodu podatkowego nie znajduje się sytuacja, gdy, w której podmiot gospodarczy wytwarza dany, towar i przesuwa dzień uzyskania przychodu do momentu jego sprzedaży.
Z uwagi na to wydobycie kryptowalut nie może zostać zakwalifikowane do żadnej kategorii przychodów zawartych w art. 12 ustawy o CIT. Tym samym, pierwotne wydobycie waluty nie tworzy obowiązku podatkowego. Stanowisko to potwierdza także nowelizacja art. 7b ustawy o CIT, która została dokonana ustawą z dnia 23.10.2018 roku o zmianie ustawy o podatku dochodowym od osób fizycznych, ustawy – Ordynacji podatkowej, ustawy o podatku dochodowym od osób prawnych i nie tylko.
Znowelizowany art. 7b ust. 1 pkt 6 lit. f) ustawy o CIT mówi, że przychody z zysków kapitałowych to przychody pochodzące z zamiany waluty wirtualnej na inny środek płatniczy, usługę, towar albo prawo majątkowe. Znowelizowany art. 7b ustawy o CIT nie mówi o przychodzie z nabycia pierwotnego kryptowalut. Można wnioskować, że wydobycie kryptowalut nie powoduje powstania przychodu, o którym mówi ustawy o CIT. Ani spółka, ani użytkownik platformy nie uzyskują więc przysporzenia, które podlegałoby opodatkowaniu.
Organy i ich stanowisko dotyczące górników kryptowalut
Dyrektor Krajowej Informacji Skarbowej stwierdził podobnie jak spółka, że samo wykopanie waluty wirtualnej nie generuje przychodów wymienionych w ustawie o CIT. Tym samym czynność ta nie zobowiązuje do opłat podatkowych w podatku dochodowym od osób prawnych. Przychód powstaje dopiero w momencie zbycia tej waluty. Jednak do przychodów nie można zaliczyć wartości waluty wirtualnej, którą otrzymano w zamian za daną walutę.
Kwintesencja ta jest miłą odmianą dla podatników. Trudno bowiem uznać za przychód wytworzenie czegoś z wykorzystaniem jedynie własnych sił. Nie należy zapominać, że ostatnio wydano wiele orzeczeń podatkowych niekorzystnych dla polskich podatników. Mowa o niemożliwości zaliczenia do kosztów wydatków dokonanych na sprzęt, który służy wydobywaniu kryptowalut. Inne orzeczenia mówiły o braku możliwości rozliczenia straty wygenerowanej podczas obrotu walutą wirtualną a poniesionej przed 2019 rokiem. W bilansie ogólnym nowelizacja przepisów z początku 2019 r. i ich wykładnia wykonywana przez fiskusa w znacznym stopniu utrudniają podatnikom prowadzenie aktywności biznesowej w tym zakresie.
