Rosyjski Bank Centralny będzie popierał zakaz używania Bitcoina, jeśli takie prawo zostanie wprowadzone w Rosji. Instytucja wyraziła negatywną opinię wobec tej kryptowaluty.
Bank Centralny Rosji przeciwko Bitcoinowi
Bank Centralny Rosji 29 listopada zajął stanowisko wobec Bitcoina, w którym zwrócił uwagę na zagrożenia wiążące się z jego używaniem. Zdaniem Banku kryptowaluty charakteryzują się bardzo dużym ryzykiem inwestycyjnym, co sprawia trudności z oszacowaniem efektów wahań kursowych, a do tego ułatwiają wspieranie działań przestępczych. Z tego powodu RBC nie patrzy przychylnie na rozwój rynku kryptowalut w Rosji. Jego zdaniem to rubel powinien pozostać jedynym środkiem płatniczym w kraju.
Bitcoin nie może zagrozić rublowi
– Na terenie Federacji Rosyjskiej to rubel jest zgodnie z prawem środkiem płatniczym. Uważamy, że kryptowaluty są obciążone znacznym ryzykiem i niosą ze sobą zagrożenia takie jak finansowanie terroryzmu czy pranie brudnych pieniędzy, a także że podlegają dużym wahaniom kursów – przekonuje rosyjski regulator rynku finansowego w swoim oświadczeniu. Jego zdaniem nie należy traktować kryptowalut na równi z pieniędzmi i uznawać ich za środek płatniczy.
To nie pierwszy komunikat o negatywnym nastawieniu do kryptowalut wychodzący w ostatnim czasie z Banku Rosji. Na początku listopada po jednym ze swoich posiedzeń wydał on oświadczenie odnoszące się do tego, co nazwał „substytutami pieniężnymi”. Także wówczas instytucja zadeklarowała swoją niechęć do kryptowalut i zaznaczyła, że nie wspiera prywatnych aktywów cyfrowych, dodając jednocześnie, że będzie się uważnie przyglądała rozwojowi tego rynku.
Rosyjskie prawo wobec kryptowalut
Warto przypomnieć, że status prawny kryptowalut w Rosji ciągle jest niejasny. Do tej pory nie został on właściwie uregulowany przepisami. W ubiegłym roku w rosyjskiej Dumie pojawiły się trzy różne wnioski o to, by wreszcie ustanowić prawo regulujące kwestię aktywów cyfrowych. Udało się to zrobić jedynie częściowo. Deputowani przyjęli dotąd dwie propozycje. Wprowadzono zapisy w kodeksie cywilnym, które odnoszą się do praw cyfrowych, a ponadto przyjęta została nowa ustawa o pozyskiwaniu funduszy poprzez platformy inwestycyjne.
Nadal jednak brakuje kompleksowego uregulowania całej dziedziny gospodarki cyfrowej, stąd kryptowaluty także są w pewnym sensie zawieszone w prawnej próżni. Nie ma choćby żadnych przepisów dotyczących ich wydobywania czy ICO, co tylko zwiększa niepewność działania całej branży. Co jakiś czas pojawiają się jednak nowe propozycje uregulowania tej sfery gospodarki. W Ministerstwie Finansów Rosji w październiku powstał projekt klasyfikowania kryptowalut z podziałem na trzy różne prawne kategorie. Z kolei kilka miesięcy wcześniej pojawiła się informacja mówiąca dużo o niechęci rosyjskich władz do cyfrowych rozwiązań finansowych. Według niej Ministerstwo Spraw Wewnętrznych w tym kraju pracowało nad projektem prawa umożliwiającego konfiskatę aktywów cyfrowych, w tym kryptowalut. Nie jest do końca jasne, w jaki sposób technicznie taka konfiskata miałaby być przeprowadzana.
