Regulacja działalności giełd kryptowalutowych w Hongkongu
Ze względu na przyjazne prawo Hongkong często wybierany jest na siedziby firm z branży kryptowalutowej i powiązaną z nią technologią blockchain. Tymczasem 6 listopada tamtejsza Securities and Futures Commission (SFC), czyli Komisja ds. Papierów Wartościowych i Kontraktów Terminowych ogłosiła wprowadzenie nowych ram regulacyjnych dla platform zajmujących się handlem kryptowalutami.
Regulator ds. finansów opracował ramy dla giełd kryptowalut w Hongkongu Do tej pory prawne regulacje skupiały się głównie na ochronie inwestorów na giełdach kryptowalutowych przed oszustwami, obecne mają poszerzać kontekst nadzorczy i wpisują się w ogólnoświatowy trend.
Impulsem jest oczywiście Libra i związane z nią kontrowersje natury regulacyjnej. Komunikat SFC ogłasza, że platformy oferujące handel aktywami wirtualnymi będą mogły ubiegać się o przyznanie licencji SFC i będą to licencje zbliżone zakresem do przepisów dla brokerów oferujących handel papierami wartościowymi. Do ich uzyskania potrzeba będzie jednak spełnienia kilku warunków, m.in. przynajmniej jeden z oferowanych przez giełdę aktywów będzie musiał mieć status tokena typu security (papieru wartościowego).
Dla giełd kryptowalutowych zostaną również wprowadzone wytyczne stworzone specjalnie dla nich. Innym jeszcze wymogiem będzie skierowanie usług giełdy wyłącznie w stronę profesjonalnych inwestorów lub klientów z obszerną wiedzą na temat aktywów wirtualnych, a jakby tego było mało, nie wszystkie aktywa będą mogły być oferowane na giełdach, lecz wyłącznie takie, które spełnią określone kryteria. Szef SFC, Ashley Alder wyjaśnił m.in., że regulatorzy muszą stawić czoła ryzyku jakie niosą za sobą nowe technologie i przede wszystkim chronić inwestorów, gdyż właściwie uregulowany rynek leży w interesie publicznym.
SFC ostrzegło również przed opartymi na dźwigniach finansowych kontraktami futures, które są słabo uregulowane, a inwestorzy narażeni są na duże skoki cenowe. Szef SFC ashley Alder i jego inicjatywy Publikację nowych ram prawnych ogłosił sam szef SFC Ashley Adler, który już przed rokiem mówił o planach nowych inicjatyw związanych z walutami cyfrowymi.
Rok temu mówił m.in. o tzw. piaskownicy regulacyjnej dotyczącej rozmów pomiędzy regulatorami a giełdami, w związku z czym sam odbył wiele spotkań, z których wywnioskował, że wiele giełd kryptowalutowych spełnia wystarczająco mocne kryteria, aby można je było objąć nadzorem regulacyjnym.
Faktem jest, że giełdom z Hongkongu udawało się unikać bezpośrednich kontroli regulacyjnych, a to dlatego, że większość aktywów cyfrowych nie jest klasyfikowana jako papiery wartościowe. Nowe przepisy będą oparte o standardy, które SFC stosuje wobec brokerów od tradycyjnych papierów wartościowych. Dotyczyć będą powiernictwa, AML, KYC, rynkowych manipulacji plus to, co charakterystyczne dla giełd kryptowalut.
To ostatnie oznacza, że regulacje odnośnie do giełd tradycyjnych będą się jednak różniły od zastosowanych do licencjonowanych giełd kryptowalutowych, a SFC zaznacza, że nie wyda licencji ani nie obejmie nadzorem giełd, na których odbywa się handel wyłącznie walutami wirtualnymi lub tokenami nie będącymi papierami wartościowymi. Hugh Madden, stojący na czele BG Group uważa, że wydany komunikat to właściwie akceptacja walut cyfrowych w Azji iże jest to moment przełomowy dla sektora finansowego tego regionu.
