Ukraina: Właśnie przedłożono parlamentowi Ukrainy, czyli Radzie Najwyższej, projekt ustawy, która określa sposób opodatkowania dochodu uzyskanego z obrotu kryptowalutami.
Ustawę przygotowało ukraińskie międzyfrakcyjne stowarzyszenie parlamentarne Blockchain4Ukraine, Ministerstwo Transformacji Cyfrowej, a także organizacja BRDO, czyli Better Regulation Delivery Office. Ukraina pragnie zmian w podatkach od zysku z obrotu kryptowalutami
Autorami przygotowanego dokumentu jest 13 członków parlamentu. Osoby te ustawiły za cel zmianę obowiązującego na Ukrainie kodeksu podatkowego oraz wprowadzenie do panującego obecnie prawa kilku najważniejszych koncepcji dotyczących zasobów kryptowalut.
Ustawa ta opisuje takie aktywa jednoznacznie jako „rodzaj cennej cyfrowej własności, który został utworzony, rozliczony oraz zbywany w sposób elektroniczny”.
Definicja ta ma obejmować nie tylko kryptowaluty, ale także tokeny i inne wymienione w projekcie aktywa.
Jesteśmy niemalże pewni, że tego typu ustawa (projekt) umożliwi uruchomienie rynku aktywów w wersji wirtualnej w sposób odpowiedni z ustawodawstwem panującym na Ukrainie, zwracając uwagę na równowagę pomiędzy interesami podmiotów angażujących się w interesy z wykorzystaniem aktywów wirtualnych oraz państwa, uzyskującego dodatkowy przychód podatku od nich.

W przypadku, gdy ustawa zostanie zaakceptowana przez parlament, dochód od obrotu aktywami cyfrowymi będzie liczony jako różnica pomiędzy ceną, za jaką je zakupiono a kwotą otrzymaną podczas ich sprzedaży. Tego typu zyski powinny zostać zdefiniowane przez osiągających je podatników jako „inne dochody”.
Dochody od obrotu kryptowalutami miałyby być opodatkowane wedle stawki standardowej, która obowiązuje na Ukrainie, czyli 18 procent. Brana jest jednak pod uwagę możliwość wprowadzenia 5-procentowej stawki początkowej od dochodów osobistych od sprzedaży typu kryptograficznego przez okres 5 lat od zatwierdzenia ustawy. Sprzedaż kryptograficznych aktywów nie będzie podlegała podatkowi VAT.
Tokeny i Podatki
Zasoby poddane tokenizacji miałyby inne funkcje podatkowe. Definiowano by je jako cyfrowe aktywa, świadczące o własności lub prawie niemajątkowym. W tej wersji tokeny mogłyby podlegać takiemu samemu opodatkowaniu, jak towary oraz usługi, które je wspierają.
Michael Chobanian, który jest założycielem Kuna — ukraińskiej giełdy kryptowalut oraz prezes Ukraińskiego Stowarzyszenia Blockchain, stwierdził, że ma nadzieję, że prawo zostanie wprowadzone w życie, istnieją jednak innego typu przeszkody przed branżą i należy je usunąć.
W przypadku, gdy Narodowy Bank Ukrainy nie umożliwi innym bankom otwierania i prowadzenia rachunków firmom kryptowalutowym na Ukrainie, to nic w branży w rzeczywistości nie ulegnie zmianie.
